EXPLANATION OF THE TRAVEL CONDITIONS AND GENERAL INFORMATION
BOOKING
If you desire more detailed information on the accommodation of your choice before you fill in the reservation form, telephone or mail us. The better we are informed of your expectations and wishes, the better we can advise you adequately.
When you have chosen a certain accommodation, fill in the reservation form and mail it to us. We will then check for you if the accommodation in question is available in the period of your choice. You can of course also phone us to enquire about the availability. If the accommodation of your choice is available, we immediately take an option on your behalf, stating also your eventual particular wishes, and inform you. You then mail or send us your definite reservation. Upon receipt, we change the option into a definite reservation.
When your definite reservation has been received by us, we will send you a confirmation of your reservation/invoice. On this reservation form you will find all costs specified. You will send us one of the two copies with your signature and pay the deposit. At the latest six weeks before your departure the total amount due has to be settled. For the cost of reservation/booking the amount of € 25,00 is charged. For clients from non-Euro countries, an amount of € 40,00 is charged.
Reservations in writing, telephone or verbal, by fax, e-mail or mail are binding.
PRICES
The prices of the accommodations are presented in the chart of the concerning web-pages and given in Euros. The rental period for villas and apartments is a week (unless otherwise stated), from Saturday to Saturday. For hotels the rental period generally starts with a minimum of 3 days. The amounts mentioned on our website are based on prices, taxes and duties, as known to us on November 1-2005. These prices are valid for the whole season, up to November 1-2006.
For periods not mentioned on the appropriate web-pages the prices are available on request.
PERSONAL DATA
It is required that you provide all the personal data which can be of importance to the proper implementation of your reservation. This applies not only to the mention of a mental of physical handicap, but also to other information which might be of importance to a proper implementation (see the travel conditions). Verbal agreements and/or promises, not confirmed in writing, are not valid.
PAYMENTS
After receiving the confirmation of the reservation/invoice, 30% of the total amount due has to be paid. The remainder of the costs of the journey has to be paid at the latest 6 weeks before the day of departure (or in case of self-arranged transport, before the date of arrival in the first booked accommodation). For the extensive payment conditions we refer to article 3 of the travel conditions.
TRAVEL DOCUMENTS
In regard to travel documents, E.T. will provide you with the necessary general information. However, you yourself are responsible for the required documents needed for the journey (see also the travel conditions). Before departure you have to make inquiries whether all your documents are still valid and/or up to date. A valid passport or an European identity-card is required for any traveller of Dutch nationality. To travellers with another nationality we advise to gather information with the concerning authorities, because for them other regulations or conditions might be required.
If the journey should not take place due to the lack of the necessary documents, the normal conditions of cancellation will be implemented. Be aware of the fact that on many countries banks and post offices do not accept an identity-card as proof of identification if you want to cash a cheque.
If you travel by plane take care that the name in your passport matches the name on your ticket. If those two documents are not exactly the same the airline company is entitled to refuse you. If a new ticket has to be obtained, E.T. is not responsible for the costs involved.
ROUTE DESCRIPTION (itinerary)
With your travel documents you also receive a route description to the place of destination. The last part of this route description is in detail, so that you can easily reach your holiday address.
DEPOSIT
For most of the accommodations (villas and apartments) a deposit is requested, which you have to pay to the owner/caretaker on arrival. At the end of your stay you will receive a repayment of your deposit, after deduction of extra expenses (like costs for heating and final cleaning) or damages caused by you. It might also happen that settlement will take place afterwards, for example: if you leave very early in the morning and the reception is not open yet and the owner/caretaker has not been able to check your holiday home. In that case you leave the number of your bank account. Payment and repayment of the deposit is a question between tenant and owner/caretaker.
E.T. will not accept any responsibility, nor influence or liability in case problems might occur by payment of repayment of the deposit.
ESSENTIALS AND PREFERENCES
If you have special wishes/preferences regarding the accommodation of your choice (e.g. a sea-view, or housing on ground level), these have to be requested upon booking. E.T. will take care of informing the owner/caretaker about your wishes, but cannot guarantee that they will be granted, because the ultimate decision lies with the owner/caretaker.
If your wish is of such importance (for example a diet) that booking or not is depending on it, we call it a matter of vital importance. In that case you have to express this explicitly on your reservation form. E.T. will inform you by writing if this matter of vital importance has been accepted. In that case you will be charged extra costs of € 25,00. For further information we refer to our travel conditions, article 2, part 5.
ARRIVAL AND DEPARTURE
For all accommodations applies in general that you are not supposed to move in before 04.00 p.m. At the last day of your stay you are expected to leave the accommodation before 10.00 a.m. In general most hotels have the agreement that you leave the room before 12.00 noon. On the website you will find in the descriptions of the accommodations under "particulars" the exact time of arrival and departure. You will find these time tables also on the voucher you will receive.
In case of difficulties reaching your place of destination in time, a call to the owner/caretaker is needed (the telephone number is given on your travelling documents); otherwise you run the risk that your accommodation is no longer available. In that case the costs will not be repaid.
TRAVELLERS REQUISITES
Around two weeks before departure you will receive a package with the following travellers requisites:
- A travel guide of the region, if available
- A voucher in which you will find address and telephone number of the destination en information on other agreements, like deposit and costs for cleaning etc.
- The route description to your destination
- Photo, description and brochure (if available) of the accommodation
- Several maps of cities and/or region, if available
- E.T.’s own regional information with restaurants, shopping and places of interest
- Other brochures with tourist information, if available
- Travel conditions and explanation of the travel conditions
PETS
In most cases pets are not allowed. If it is nonetheless allowed, such is stated in the description of the accommodation (usually extra costs are charged). If you want to take a pet with you, you have to state this on the reservation form. If permission is granted you will receive confirmation of this in writing from E.T. Officially all dogs in Italy are obliged to wear a muzzle. Do not forget that any pet needs to have a valid and up to date certificate of vaccination. At several places, like beaches and restaurants, dogs are not allowed.
INSURANCE
We strongly advise you to take out a travel- and cancellation insurance. For the travel insurance the duration of the journey is given in full days, which include the day of arrival as well as the day of departure, regardless of times of arrival or departure. The costs of a cancellation insurance is 5% of the costs of the journey. This amount has to be paid together with the first down-payment.
DISABLED PEOPLE
People with a handicap are requested to give us as much information on the specifics of their handicap, so that research can be done to find out if the accommodation of your choice is suitable for you. Consultation about this is always essential.
CANCELLATION
Any confirmed reservation has to be cancelled at E.T. Cancellation costs are applicable, as well as an administrative fee of € 27,00 per reservation. The conditions appertaining to cancellation are given under art. 9 of the travel conditions.
SUBSTITUTION/REPLACEMENT
Your attention is drawn to the fact that it is possible, in case you yourself or someone in your party cannot travel, for someone else to take this place. Please check the travel conditions.
LIABILITY
E.T. cannot be held responsible for theft, loss (including money), damages to properties or injuries inflicted on her clients. The rental party/lessor is free to require that the renter and his/her party follow his guidelines on the use of the rented accommodation. Eventual damages to the holiday accommodation are directly payable by the renter and/or his fellow travellers. Fellow travellers are all those who form part of the renter’s party and/or are otherwise involved in this party. It is therefore very much recommended that renter disposes of a liability insurance valid abroad. If eventual damages have not been settled with the lessor/owner of the holiday accommodation, E.T. is authorized to hold the renter and his/her party responsible for the damages caused. All costs involved are payable by he/she whose name is given as the main renter. He/she who books the travel is responsible for all others whose names are given on the reservation form.
CONSTRUCTION ACTIVITIES, NOISE NUISANCE, ENVIRONMENTAL PROBLEMS AND INTERIM CHANGES ON THE ACCOMMODATION
It may occur that construction activities take place in the vicinity of your holiday accommodation. E.T. cannot be held responsible for this in any way. You will understand that such is an unforeseeable circumstance. The same applies to other forms of noise nuisance. E.T. cannot be held responsible either for environmental problems, such as pollution of the seawater and/or interim changes on the accommodation concerning facilities, furnishing and extra costs done by the lessor/owner.
BED LINENS ETC.
In most accommodations, bed linens etc. are at the disposal of the renter (see the description of the accommodations, heading “Particulars”.) If this is not the case, bed linens etc. are for hire at the chosen accommodation or renter will have to take his own along from home. Usually, bed linens etc. are once weekly replaced by clean ones.
ENERGY COSTS
Costs for gas and electricity are usually included in the rental price. If not, costs are calculated according to usage. Costs for heating generally are not included in the rental price and have to be paid before departure/when checking out. Unless otherwise stated, this also applies to wood for the open fire place. You have to take into account that heating costs in Italy are much higher than in The Netherlands and possibly other countries outside Italy.
EXTRA COSTS
In the description of the accommodations, under the heading “Particulars”, you find the extra costs you will have to take into account. Unless otherwise mentioned, these costs are payable before departure/when checking out.
FINAL CLEANING
In the description of the accommodations, under the heading “Particulars”, you will find whether or not the final cleaning is included in the rental price. In most cases, however, these costs are not included and are payable before departure/when checking out. In both cases it is expected that you leave the accommodation clean and tided up.
USAGE OF SWIMMING POOL AND OTHER FACILITIES
Outside high season it might be possible that the swimming pool of your accommodation and/or other facilities have not yet been opened or have already been closed down. In both cases, E.T. cannot be held responsible. If opening times are available, these will be mentioned in the description or will be given to you. In general, swimming pools are open from the beginning of June till the end of September. This is, however, also dependable on the weather. It is also possible that the swimming pool belonging to certain apartment complexes will be closed in the evening due to noise nuisance.
PARKING FACILITIES
Garages and private parking lots are not always free of charge. Costs appertaining hereto to be paid on the spot. Parking always at your own risk.
COMPLAINTS
If you establish certain defects and/or deficiencies at your holiday accommodation, you are advised to immediately report such to the lessor/caretaker/owner. If nobody is present, or if your complaint is not dealt with to your satisfaction, please contact E.T. in The Netherlands, who will then take the necessary action. See also the travel conditions, article 17, for the complete procedure in case of complaints.
MAXIMUM NUMBER OF PERSONS PER ACCOMMODATION
The holiday accommodation rented by you can only be used by the number of persons given on your reservation form or the maximum number of persons allowed for that specific accommodation. Unless otherwise stated, babies are included in this maximum number. It is absolutely not allowed to receive visitors and/or have them stay overnight at your holiday accommodation without specific permission of the lessor/caretaker/owner. The usage/housing of more than the maximum allowed number of persons is absolutely forbidden, on pain of immediate removal from the rented accommodation. It is also forbidden to pitch tents and/or other camping material in the garden.
TOURIST TAX
In case tourist tax has to be paid, which in some places in Italy is levied, these costs have to be paid on the spot.
CHILDREN’S COT
Most accommodations offer the possibility of renting a children’s cot etc. for extra costs (see the description of the accommodation of your choice, under the heading “Particulars”). In most cases, you will have to take your own sheets for these cots along.
CHILD FRIENDLY ACCOMMODATIONS
We feel that unsupervised children are always at risk whether at home of abroad, and that it is impossible to make absolute recommendations about a property being totally safe for children, as the needs of every family are different. If you are travelling with infants or children, please contact us, and we will be pleased to make suggestions about the general suitability of each acoommodation.
DESCRIPTION OF THE ACCOMMODATIONS
Elisabeth Travel’s website offers villa’s, apartments and hotels for rent. Hotels and residences are, as a matter of course, official tourist structures. This is not the case where private housing is concerned, and that is the reason that these cannot be divided into the internationally applicable categories.
They are, in building style and furnishing, a reflection of the owner’s personal taste and the regional traditions. When compared to the houses offered for holiday rental in The Netherlands and other countries, there is a big difference with those in Italy. In by far most cases the latter is judged positively, but in some cases it is not. However, this cannot be accepted as a valid complaint. Moreover, you have to take into account that when you rent an apartment in an agriturismo, fattoria, podere or a residence, you will always have neighbours. As far as the furnishing/equipment is concerned: A Dutch coffee-maker and a potato-peeler do not belong to the standard kitchen equipment. Beds are sometimes shorter and the dining table/sofa corner sometimes offer less seats than the maximum number of persons allowed for that particular apartment.
FOUNDATION ARBITRATION BOARD CONSUMERS’ AFFAIRS
Elisabeth Travel is member of the Stichting Geschillencommissie Consumentenzaken (as translated above). This board arbitrates in case of disagreement between two parties. Its verdict is binding for both parties (also see the travel conditions).
SOME OTHER GENERAL CONDITIONS
All descriptions on the website are made in good faith. E.T. cannot be held responsible for eventual changes made by the owner without informing her of such. Eventual mistakes or defaults on the website are not binding. E.T. cannot be held responsible for the correctness of information given by third parties and/or brochures and pictures. The pictures on the website give an impression of the accommodation to which they belong. Although carefully selected and representative of the surroundings, your selected holiday accommodation might not be in all cases as specific as the pictures showed.
This explanation of the travel conditions and general information are an indissoluble part of the travel conditions of Elisabeth Travel. This applies also to the published prices on the website and the general rental conditions which several partners in Italy employ for the rental of accommodations of their organisation.
N.B.: For some accommodations, there are different cancellation conditions applicable. Information will be given upon request.
BOOKING CONDITIONS PARTNER
All bookings are made, via with SALOGI S.r.l. Salogi S.r.l. is an agent with power of attorney of the Principal (owner of the property). Your signature on the booking form will be taken as your and your party’s acceptance of the following conditions:
1. BOOKING
A deposit of 30% of the property rental must be paid. No contract with us will exist until we have received this amount and the booking form duly signed, and have subsequently confirmed your booking. Should you later cancel, cancellation charges will become payable in accordance with paragraph 3.
2. PAYMENT OF THE BALANCE
The balance of the payment must be paid at least eight weeks before departure. If the balance is not received by us by the due date, we shall be entitled to cancel the booking without prejudice to our claim for cancellation charges, and to retain the deposit. For bookings made within eight weeks of departure date, you will be required to pay the full cost of your holiday at the time of booking.
3. CANCELLATION BY YOU
It is agreed between us that should you wish to cancel all or nay part of your booking, or that the booking is cancelled by us due to non-payment, then we shall be entitled to the following percentage of the holiday cost:
8 weeks or more before departure Deposit (30 %)
8-6 weeks before departure 50 %
6 weeks-departure date 100 %
Cancellations must be received in writing by us.
4. ALTERATIONS/CANCELLATIONS BY US
Though it is unlikely that we will have to make any changes to confirmed arrangements, it does occasionally happen, and we will advise you at the earliest possible date. If for any reason beyond our control we are unable to provide you with the property you have booked, we reserve the right to transfer you to a similar property. However, if this is not possible or you do not wish to be transferred, we will cancel the booking and refund the amount paid to us for the property, but we will not be liable for any cancellation charges for travel arrangements.
5. MINIMUM LETTING PERIOD
On some of the properties, especially on large villas, the minimum letting period is two weeks. Please check with us if the property you are interested in accepts one-week rentals.
6. NUMBER OF PERSONS/REPLACEMENTS
Only those persons stipulated on the booking form may use the property. The number of people must not exceed the number of sleeping places indicated in the brochure. Should the key holder find more persons than those stated, it is totally up to his discretion to ask the clients to vacate the house. Infants (children under 2 on date of return) are not included in occupancy figures. However many owners limit the number of infants/toddlers. Each child over 2 (whether sleeping in a baby cot or not) will be counted as part of the villa occupancy.
7. COMMERCIAL USE
Should clients intend to use a villa for any type of commercial use such as photo shoots or filming this should immediately be advised at the time of booking. Such use will only be allowed with the written consent of Salogi, who in turn will implement specific arrangements and stipulations thus imposed by the villa owner. No private parties, weddings, wedding receptions or large gatherings are allowed in the properties without written permission from Salogi. No camping is permitted on the property grounds.
8. INSURANCE
It is a condition of booking that your party is covered by comprehensive travel insurance including coverage against trip cancellation. The appropriate coverage should be purchased at the time of the booking. Please contact your travel agent, travel consultant or insurance broker about this. Your signature on the booking form confirms that you are covered by such insurance. NOT APPLICABLE
9. ARRIVAL AND DEPARTURE TIMES
Clients must arrive between 4 p.m. and 7 p.m. and leave before 10 a.m. on the day of departure. If the client is late, advance notice must be given in writing. In case of flight delays or inconvenience while travelling, clients should contact our office or the local housekeeper. Late arrivals are very difficult to be arranged and the housekeepers may reserve the right of asking for an extra fee, depending on the single case. In any case it is not possible to arrange arrivals after 10 p.m. It is up to the key holder’s discretion to decide whether or not to allow clients to enter the house at times other than those stated. Salogi declines all responsibility in the matter.
10. SECURITY AND TELEPHONE DEPOSITS
A security deposit as stated in the price list is payable upon arrival to the key holder in cash (any currency) or with traveller cheques (duly filled and signed). This is to cover the costs of any damage or breakages during your stay to the property or the contents. This amount, less any applicable claims, will be returned to you on the morning of departure. Failure to pay the deposit can result in the key holder refusing entrance to the house.
If the property has an outgoing telephone you will be asked for a deposit of 250 Euro (in cash).
11. COMPLAINTS
We have visited and checked each property and the descriptions in the brochure are therefore accurate and made in good faith. However we decline all responsibility for any modifications made by the owners without our knowledge. We also do not accept responsibility for the breakdown of the supply of water, gas or electricity nor of swimming pool filtration systems though we will use our best endeavours to arrange for these problems to be solved. If you have any problem during your stay which cannot be satisfied by dealing directly with the owner or manager of the property, you should contact us immediately. It is impossible for us to claim compensation from the owner after you have returned from your holiday if you have not recorded the problems with us during your stay. Complaints lodged only at the end of the holiday period will not be taken into consideration. Clients who abandon the house without authorisation from Salogi lose all rights to any eventual refund or rebate.
12. CLEANING
The property will be clean throughout at the beginning of the rental period and must be left by the tenant clean throughout at the end of the rental period. If the property is not left in an acceptable condition the sum of 40 Euro per person will be deducted from the security deposit. Linen is normally changed once a week.
13. BEHAVIOUR
The client signing the contract is responsible for the correct and decent behaviour of his party. Should the client and his party behave in a manner that is not acceptable by civilised standards, the key holder may ask the client and his party to vacate the house.
14. PEOPLE WITH HEALTH ISSUES
People with disabilities or health issues should verify with us the suitability of the property that they are considering. Our properties are in the countryside, and bugs, spiders, wasps and domestic animals are common in rural settings. Please take note of this in case someone in your group has serious allergies.
15. LOW SLUNG CARS
Most of our houses are located in the countryside. Some of them can be accessed only by unsealed roads and driveways. We therefore advise people intending to take a sports or low-slung car on holiday, to check with us first whether the access to the property allows for such a car. We advise against the use of vans and minibuses. Please always check with us at the time of booking, if you are planning to use this type of vehicle when staying at one of our properties.
16. PETS
Pets are generally not accepted by house-owners. If you want to bring one with you, please check in advance if this is possible. If accepted you will be requested for an additional security deposit and/or adequate insurance.
17. SWIMMING POOLS
Swimming pools are not open all year. If your rental period is outside the period 26 May to September 29, please check with us that the pool can be opened. Swimming pools are not enclosed with fences and there are no lifeguards. Clients' use of the swimming pool is at their own risk. Children must be supervised at all times. Neither the villa owners nor Salogi and its agents assume responsibilities for use of the swimming pools.
18. MAID SERVICE AND COTS
It is usually possible to arrange maid service but this cannot be guaranteed. The costs vary in different areas – approximately 15 Euro per hour – and are paid locally. If a maid is booked in advance her services cannot be cancelled locally without payment. Not all houses have cots and a few have more than one.
19. HEATING
Heating costs are not included in the price and must be paid directly on the spot to the owner or his/her representative before departing. Please note that heating in Italy, when not subject to restrictions by the local Government, is more expensive compared to other countries. If you look for a property in low season, make sure to ask for an estimate of the heating costs.
You may be asked a supplementary deposit for heating expenses.
20. WATER AND ELECTRICITY
Please note that most of the properties that we offer are not the typical purpose-built Mediterranean holiday villas. Most are converted farmhouses or former manor houses, full of character and history. Water shortages do occur; please use it sparingly during the summer months. At the same time, Italy is probably one of the few countries in the world where the Government has introduced a system of electricity limitators to contain the national consumption. This means you must be careful when using more than one appliance at once because the limitator will shut the electricity off.
21. VALUABLES
Valuables left at the property are the clients risk. Neither SALOGI nor the owners (nor their staff) are responsible for their loss.
22. LAW-JURISDICTION
In the event of any dispute concerning the terms and conditions of this contract, the court of law of Lucca will have jurisdiction and Italian Law will be applied. On signing the booking form the client totally and unconditionally accept these booking conditions. |
